Frankly, I think saying he lost isn't accurate (if for no other reason than he gets exposure now and potentially later with another go at this fella).

Rather, I'd characterize it as he tried to use a driver full-swing to sink a 3' putt ... even if he lacked the skill to make what seemed to be a 'gimmee', he should've had the sense to use a different approach ... any other approach ... than what he elected to go with ... which, if I were looking to defame him I would now be able to argue that he's more interested in his own media exposure rather than some high moral ground ... I don't think that's necessarily true but, as I say, the argument is not difficult to craft now because of his missteps this afternoon.

In the Penn State case this is the right view given all the overwhelming evidence. However, there's zero doubt Dan bring this mindset to every crime involving a victim and accused perpetrator.

Bernstein leads off with an incredibly leading question, letting Lubrano know right off the bat how things are going to go down. He lost any chance at getting anything with that first "question". His insistence on trying to go for the jugular again with the second question (repeated 3 times, "do you think the victim is lying?") is amateur-hour on display. Bernstein saw his chance to play big-boy lawyer with a pariah he in large part created, and dribbled it down his leg like he was auditioning for a Law & Order role.

5 minutes in, and Bernstein is really showing his ass trying to treat Lubrano like any other Penn State caller, like Lubrano doesn't know that calling someone a liar is actionable. Also telling that Bernstein had to hide the fact that all this new information is from a deposition, not sworn testimony in front of a court. His claims of "perjury" are completely unfounded. Jon Doe's lawyer would never get away with such leading and presumptive questions on direct.

Bernstein brought up emails sent to him by Lubrano's ex-wife talking about their marriage and personal relationships. What a piece of shit.

Wow. Just listened to it. Both Bernstein and the trustee are unhinged, insane people.

Bernstein: From an email she sent me.

Rozner just kicked his heels up during that interview. He got maybe 2 questions in cuz he wanted people to know he was there. Basically repeating Dan's questions. But Bernstein dominated that 15 minute interview.

This was Dan's finest on air moment...in Dan's mind.

Of the two, Lubrano seemed to have his shit together better than Bernstein. Danny had nothing to say about the difference between testimony given at a deposition, and testimony given in open court, McQueary's changing testimony, and the uncorroborated 3rd-hand words of someone not being deposed serving as evidence of coaches going to Paterno.

Berstein's trump cards were asking directly whether Lubrano thought the victims were liars (an answer he should've known he wouldn't get) and telling Lubrano that his wife was emailing radio personalities about their marriage falling apart. Neither of them were very effective, and all Bernsie and Rozner had left was "b-but, muh sworn, testimony".

The ex-wife e-mail was lowest of the low. I couldn't believe he brought that on-air.

Bernstein was going on one of his meandering, leading questions about why Lubrano was so invested in clearing Paterno's name, and he said something like "you became so unhinged in your quest that even your wife left you..." at which point Lubrano interrupted and said he was going to hang up if all Bernstein had left was personal attacks, saying his wasn't unhinged or deranged, to which Bernstein replied "that's not what your wife said when she emailed me".

Turns out that was Bernstein's source for a bunch of the goings-on in the Penn State BoT: an email address claiming to be Lubrano's wife/ex-wife.

Bringing that up was absolute trash.
