listened to interview last night. the guy did evade the direct question about whether he believed the accusers were lying or not. Bernstein was definitely caught off guard when someone else used his "be specific" interview tool against him. Also was real shitty of danny to bring up the guys divorce when it had nothing to do with the conversation. Bernstein basically let the ball slip out of his hands while trying to spike it.

If so, I stand corrected. I thought were were told during the Kane stuff that no rape can occur without penis penetration. I thought the legal folks would use sexual assault, sodomy or other terms without that.

In actuality, the guy was trying, without any success, to explain how the legal system works to Dan. And the question was not evaded. He doesn't have to have an opinion of whether or not they are lying.

The guest also pointed with an example, that just because it was said in a deposition, doesn't make it factual.

He basically asked a question the guy could not answer without getting fired. It would be irresponsible for him to have responded either way.

If he responds that he thinks the victim is lying, then he would be accused of trying to influence the courts. If he responds that he believes the victim, then he undercuts the university's (his employer) case.

The truly telling thing was Dan has bad mouthed the guy for 4 years as a lunatic, yet if you listen to the interview it's clear who the lunatic was, and it wasn't Lubrano.

Lubrano wasn't some super fan, he knows the case a lot better than legal expert Dan. It seems the Twitter reaction was favorable to Dan, but I can only imagine CBS management hoping this nightmare would end shortly. Repeating child rape 20 times in a 10 min interview isn't exactly great sports radio.

The thing is Brandon Marshall really did nothing wrong. He may have had the personality to use his awareness of his mental issue for things but he never had another crime or assault that I know of. The reality to me seemed he had to go because he was a diva receiver and that is common.

To be fair, he did say publicly that he was "cured" by whatever sessions he went to, and if he does indeed have BPD, that's something that, as I understand it, can really only be maintained with regular therapy and other coping outlets, like the other two big "Cluster B" personality disorders (antisocial and narcissistic). Saying he's cured of that raises serious questions about his understanding of his own diagnosis, and even the diagnosis itself.
