Right. Jake Arrieta doesn't understand and cannot define the physics equations that describe one of his pitches. He's still one of the best pitchers in the world. People who are ignorant of definitions and meanings are not precluded from being or doing those things the words represent. Now, if it's a matter of whether someone is capable of understanding certain concepts, we assume they can't, and hold others accountable, this is not one of those scenarios. He could engage in consensual sex (and not be guilty of rape) all while not being able to spell the word, much less define it.

It was also a deposition. Depo "gotchas" don't necessarily work out all that well.

He was a lousy point guard, even when he was a far better scorer. now he's a lousy shooter, a lousy defender, a lousy distributor and a nightmare because of all this crap. he should have settled out of court to keep all this out of the press. the Bulls were very fortunate to have been able to get rid of him. Watch and see how many guys flourish with a better point guard this season.

Plaintiff and her lawyers failed to disclose possibly (meaning likely) exculpatory texts from Doe to Rose the night of the alleged rape:

That's my thought as well. My assumption is he's too dumb to be coached by his attorneys so they're hoping he comes across as such an genius the jury thinks he's not mentally capable of understanding what he did.

I know it's only a civil case but still...

It was unclear whether the death was a suicide or a homicide, Dean said.

“We’re investigating it,” he said.

News of the LAPD’s investigation of Rose came to light as an attorney representing the woman in a civil case against Rose and other men made a last-ditch appeal to a judge to conceal her identity.

The woman’s attorney, Brandon Anand, filed a request, in light of the LAPD’s investigation, asking U.S. District Judge Michael Fitzgerald to reconsider a decision to have the woman identified during trial.

And included in his request a letter from Hernandez, whom he identified as the officer investigating the case. In it, Hernandez wrote that being able to offer anonymity to people who come forward to accuse others of rape is “an invaluable investigative aid to investigators.” She added that the LAPD would continue to guard the woman’s identity throughout its investigation.

Maybe neither of them had records on their actual phones, and it was the Plaintiff who went to her provider for messages.

Regardless, going with Rose's text records (assuming he still had them from 3 years ago, NBA players are likely told to delete text messages about things like group sex) merely presents another avenue the Plaintiff can argue against: the texts were fabricated, never sent/received, from a different person, she wasn't the one texting, etc.

This way, the text history from that time period is part of her case against Rose, it's their evidence, and it is probably really, really hard to convince a jury to listen only to the parts of your evidence that proves your case, but not the defendant's.

Also, records from Rose's perspective or not, Rose has a right to demand and receive those messages before he is tried for the liability of this woman's accused rape, and to deny him them, or to obfuscate the records, is at least borderline criminal and a violation of his constitutional rights.

I was thinking more point of view of derricks legal team half assing it and pulling from his side. For a 22 million dollar case I'd think they cover all bases. But I don't know any discovery rules or him having to provide any thing they uncover.

Baute was later admonished by the judge for taking his questions outside the scope of what was allowed. Baute then went on to point out that Doe was able to use perfect punctuation and give out her address in texts she sent to Rose on the night of the alleged assault, this despite her claim that she was blacked out from drinking too much during that time. Baute then again brought up another old text in which Doe called a friend a bitch. An objection by Doe’s lawyers on the topic was sustained

Baute went to that same well one more time, saying to Doe, “In the July 23 text you did call women bitches.” That prompted Judge Michael W. Fitzgerald to tell Baute the issue would be taken up at sidebar. Doe didn’t have to answer the question, but she started to, saying, “I was upset,” while her voice cracked a little. After jurors left, Fitzgerald admonished Baute for going outside the scope of what is relevant from Doe’s past, which has been an issue for both sides in the case.

Her testimony was followed by selections of the video deposition of Keyana Lavergne, a former roommate and coworker of Doe’s who gave text messages between her and Doe to Baller Alert. One message from Doe read:

"Ok lets keep it at 90 then thats 6 months. Lol and i can even pay the whole couch off around xmas my dad gives me money not presents for xmas every year. then u just give me payment and since we finally filed against derrick we soon will be will be returning his tv and ill get us a Plasma."

Lavergne, in her deposition, said she came forward because she thought what Doe was doing was “morally wrong.” She said, “I have texts of her trying to use the situation for her gain.” She added that Doe “didn’t seem battered” or “off” at work the day after the alleged rape.

I read all that Deadspin stuff on the trial. I don't care for D Rose as I think he proved to be a self centered tool. But I was hoping he would win. It seemed like the plaintiff was just chasing the money. She obviously tried to blackmail him to pay her off with her ammo being to go public with ugly allegations. And frankly D Rose lost here because all that weird stuff in the complaint was aired for the public to see.

Before I just thought he was a shy kid with a tough upbringing. Now I think he has a lot of sick perversions.
