Betsy DeVos displayed at best confusion and at worst a lack of knowledge about a key federal law involving students with disabilities during her Tuesday confirmation hearing before a Senate panel that will vote on whether she should become President-elect Donald Trump’s education secretary.

Sen. Tim Kaine (D-Va.) asked DeVos about the federal Individuals With Disabilities Education Act (IDEA), which requires public schools to provide children with disabilities a “free appropriate public education” and governs how states and public agencies provide various services to millions of students.

Kaine asked her if she believes that all schools that receive federal funding — whether public, public charter or private — should be required to meet the requirements of IDEA.

She responded: “I think they already are.”

Kaine: “But I’m asking you a should question. Whether they are or not, we’ll get into that later.” He then repeated his question.

DeVos said: “I think that is a matter that is best left to the states.”

Kaine responded: “So some states might be good to kids with disabilities and other states might not be so good and, what then, people can just move around the country if they don’t like how kids are being treated?”

Devos repeated: “I think that’s an issue that’s best left to the states.”

Kaine said: “What about the federal requirement? It’s a federal law, the Individuals With Disabilities Education Act,” and he repeated his question.

DeVos began speaking about a Florida voucher program for students with disabilities that requires students to sign away their IDEA due process rights.

Kaine interrupted her saying, “Just yes or no.” But she continued, saying many parents are happy with the program. Kaine persisted: “I think all schools that receive federal funding — public, public charter, private — should be required to meet the conditions” of IDEA. He asked if she agreed.

DeVos said: “I think that is certainly worth discussion.”

Kaine interrupted her saying, “So you cannot yet agree with me.”

And he moved on to another subject, on which they didn’t agree.

If the school reports them as truant then it's a kid off the roster and their are no fees. So there were many immigrant families who enrolled kids, then would return to their countries for months.

Really a bizarre arrangement that mixes the worst parts of privatization and public. The charter school kids are drilled in state testing though.


Most charter schools are awful. A couple of the Noble Schools are fine. IIRC Rauner's is one of the few good ones.

Every Monday I get the paper and read about crime and shootings near Devon and Western. But I walk down Devon all the time and it NEVER occurs to me that I might get shot.

In the summertime there's an open drug market on Howard near Damen that's as brazen as anything depicted in The Wire. Now, I love Howard Street. As a kid, it represented all the grit of the city, everything that was exciting in the world. I've never been frightened on Howard Street. We used to get older guys to buy beer for us at Buy-Low when we were teenagers and I had my first legal drink at the Tally-Ho.

But I know crime and murder rates on the eastern stretch of Howard are among the worst in the City. They're trying to gentrify it, which I know won't work. Rogers Park refuses to be gentrified. Anyway, there are a couple of fancy cocktail bars on the Evanston side that got some breaks to move in there. One night I was going for a drink at one of them with a couple suburban guys and I parked on a side street. I could see that my friends were nervous, as I guess you can tell this is a place where someone might shoot you. I just can't see it that way though.

I understood that my neighborhood was violent however. I used to see the violence on a regular basis. Chicago's low end was a violence place back then.

I used to have to walk through the Ida B. Wells in order to get home from Phillips. I can remember seeing 7 guys run from one of the buildings as I walked. Don't even know if they knew who they were looking for one did (Region of the GDs) at the time. He simply commanded them to keep running and they'd see him. Once they got behind one of the buildings they let him have it. I'd had to simply stand there because if I'd taken off running they'd have more than likely shot me. They didn't know initially who they were looking for and in that split second I didn't want it to be mistaken identity


I think when you are in it somewhat you have an attitude of it being "what it is". You understand the risk and you take steps to remove yourself from it. It is the main reason I decided to go away to college. Each time I'd return I found myself more and more disconnected from the things that the "guys" were into.

Shortly before I left for college my freshman year a friend of mine turned up missing. Missing person pictures were placed throughout the neighborhood. We all pretty much knew that something terrible had happened. A couple of years later they found his body in a ditch chopped up. It turns out that a guy that'd he refused to serve drugs to on credit snapped (had a schizophrenic episode) and killed him. His girlfriend told on him and he went to jail.

I think when you are in it day to day you become immune to it after awhile. It doesn't mean that it isn't still there however.
