Requisite mens rea is the core of our legal system, it is literally half of how we determine criminality. Arguing that there is no evidence of intent to commit a crime or enter into a conspiracy to commit one is hardly a "legal technicality".

Speaking of mens rea, I don't think bickering produces winning or is intended to produce winning. (Arguing, on the other hand, is different.) Of course, me saying this may be bickering, though I prefer to think of it as quibbling.
