I wasn't arguing muskets only.

At the time of the passing of the 2nd amendment there wasn't the level of sophistication they have now. In those wars disease was a bigger killer than the guns.

That's why we can analyze them individually.

I guess that "well regulated" doesn't appear in the 2nd for MANY

I didn't read Rick's link about previous decisions on bans. My feeling though is this will be found to be too broad. One difference I think is the past bans involving magazine capacity had to do with just that the accessory itself and how many rounds it can hold.

Banning the entire firearm without either allowing a modified magazine with fewer than 10 rounds or allowing a company to reissue the magazine in a similar manner seems like an overreach.

The AR was nto banned in 94 just due to magazine. They also caught them on the muzzle flash suppressor and a couple other things to very narrowly get what they wanted banned.
