yes it is a civil suit.

Her attorney has some big cojones. But he has been pretty spot on with his moves so far.

yes it is a civil suit.

Her attorney has some big cojones. But he has been pretty spot on with his moves so far.

Damages, theoretically no, because the allegation is styled as per se defamation. The complaint alleges Trump's statement that she was lying about the guy harassing her was, in effect, a false statement accusing her of committing a statutory crime (some statute that makes it a crime to make a false statement claiming that a crime occurred - or something along those lines). (This seems pretty weak.)

As she is a public figure, she will need to prove actual malice - that he made a statement about her with reckless disregard for whether it was false or true. That actually may not be too tough to convince a jury of here.

I read or heard somewhere that this attorney represented the fans who got screwed over at the Super Bowl held in Dallas and that he completely destroyed Jerry Jones on cross examination.

It's official. Lawer quotient and those who choose to speak lawer has trumped all employable fields on the bored. One exception if we include the farmer community and include folks like me capable of not killing a tomato plant.

And I would say stormy is going to absolutely call him put on everything he says and tweets. It may be effective for her in forcing Trump to pay more, or allow her to freely talk about the tryst. There is just enough validity to this not to dismiss it out of hand. It won't go anywhere but the strategy may be very effective over time.

This is false. If the statement is per se defamatory, damages are presumed under the law. Examples would include statements that she was involved in a crime (which is what she alleges he said), that she had an STD or committed some type of misconduct in a job.
