His conduct was alarming and disturbing, which is the very definition of disorderly conduct. That is what he could have been properly charged with. Had the officer acted properly and just told the guy to shut up and move along, or he would be charged with disorderly conduct, all this crap never is a big deal. But it wasn't a hate crime and if he gets a good attorney, it will either be knocked down to DC or he will go to trial and very likely get an acquittal.
