Course, Hollywood could do what they did with the Pennsylvania pizza bomber and '30 Minutes of Less' and make the film without paying for the rights. Although I think everyone involved in the pizza bomb situation was already 6 feet under by the time the film came out.

They probably get away with the scamming the bum, because at the end of the day he's a drug addict bum who doesn't deserve that kind of money anyways. Not saying he should suffer needlessly but $400,000? Come on. There are working families in this country that deserve that way more than him.

But the IRS is gonna take em to poundtown. Ogie couldn't be more right about that. They are gonna be slaves to the Feds for a long time.

So far, the IRS has let most gofundme type donations go untaxed to the receiver under the gift tax exclusion. If someone "gifts" more than about $15K to a single individual, the giver of the gift needs to file a gift tax return and pay taxes on the gift over the exclusion amt.

I'd guess that the instance of fraud in this case would knock it out of the gift tax exclusion and make it ordinary taxable income for the malfeasant millennials.

They wont go to prison over this. Non-violent offense and their lawyer will claim that any middle class person who had an almost half-million dollar windfall would struggle to not keep it for themselves. Blowing it as ostentatiously as they did will look bad but ultimately will be excused by their youth. It's also two people, which complicates things significantly. The IRS would rather put someone in white slavery than the slammer.

They'll be ordered to pay some restitution and sell all the tangible items they bought with the money. This drug addict bum is not entitled to shit.
