Question for the lawers out there -

I have a friend that is on a municipal board, trustee, school board...that kind of thing. An elected office for the community.

Are they required to disclose their personal emails and texts to an FOIA request? They have an official email for the office but it doesn't seem like that type of office should be required to turn over their personal correspondence without some kind of court order or ruling.

not a lawyer... but i was under the understanding that any communications related to the public body were subject to FOIA production.... personal or not-public body related materials on private accounts do not need to be provided under FOIA

Now all involved have a crutch for the rest of their lives as some EXPRT will write them a lifetime letter that says "Do to a traumatic episode in there youth, they are not able to work 40 hours a week and will require the constant companship of their pet wolf" ......and I dont mean WINSTON WOLF!

That should solve it.

I would guess the board has counsel on retainer

There are many exceptions to what needs to be disclosed. You can probably find a good faith reason

In conclusion, the answer to every legal question is...maybe

Yeah, it all depends but the general rule is that emails or texts that pertain to public business are subject to FOIA, regardless of whether they are on a personal or government issued device.
