Yes, but without any hope for release why not just keep murdering inside the prison. Also, given our frequent mistakes in convictions, it seems like permanent punishment is compounding the problem.

Your second part is part of the corporal discussion. Life without parole can be fixed. "Some people you just can't Reach". I am no fan of charging juveniles as adults for anything really. And yes there should be a second chance for the young. Some young kill after their second or third chance. There has to be a way to "judge" this because there is no 100% right answer for every juvenile that kills.

two intriguing cases that i always think about when it comes to "kids who killed":

josh phillips and eric smith.

phillips killed a childhood friend brutally, but it was because he was deathly afraid of his father. they were playing around and he accidentally hit a baseball that smacked her in the head. he was so scared that his dad would find out that they were playing (which wasn't allowed if the dad didn't know about it) that he tried to shut her up from screaming. he strangled her, and then stabbed her. he then hid her body under his waterbed for a week until his mom finally discovered it. he was 14.

eric smith brutally killed and sodomized a 4-year-old when he was 12, as a result of being excessively bullied. he said when he killed the boy, he was only thinking about the bullies and that he picked the kid because he knew he'd be defenseless.

both of these guys have maintained that they have remorse and have seen how horrible the murders were. they're both still under 40, and they probably won't ever get out of jail...

the nature of their crimes is what is disturbing. who's to say that something snaps while they're out, and they kill someone again? it's something that i really can't answer.

If you aren't mature enough to make a decision about beer, you can't be making a mature decision when you murder someone.

The difference is the 15yr old doesn't go to jail for life if he steals a beer. If he murders the clerk WHILE stealing the beer then yes, they go to jail for life.
