Definitely is conflicting reports out there. I read she filed in Illinois and he filed in Tennessee. Also read that she was the one caught cheating.....so who knows where the truth is in all of this

I'm sure you have many clients who have the dumb thought that if their spouse cheated it somehow negates that spouse's claim to any of the marital estate. And I have no idea about Tennessee, but the concept of "grounds for divorce" or "fault" in Illinois is pretty much obsolete. With the way his petition in Tennessee is worded, perhaps things are different down there. It will be interesting to see where the case ultimately ends up.

Anyway, it looks like TN is both no fault and fault and old Ben is going to battle and see if he cant get things done there. From what I read separately about him and her it seems since 2005 or whatever they have lived on their estate in TN and baseball towns are temporary. So the best lawyer gets it done I guess?

You can cheat all you want and it won't have an impact on how property is divided and support calculated.

Fault, in states where that still exists, is the triggering event that gives the court the ability to grant people a divorce. Fault means having to prove things like adultery, habitual drunkenness, abuse. If you couldn't prove it then the court wouldn't divorce you.

My guess is Ben filed in TN because it has more favorable child support and maintenance laws compared to IL.

I looked up the Mrs after Kirkwood mentioned her Tatt. I had to see if it was real.....and it is. While doing my research on the tatt I came about many pics of her and she went from being a totally sweet looking hottie to completely fucking crazy. Z looked pretty much the same throughout all the pics with additional facial hair as the years accumulated.
