In short, the DuPage County Jail now has a scanner to check new inmates. The images provided in the article show the sheriff - you can see bones and other things (I'm assuming a radiologist would be able to look at the full-sized image and recognize more).

Here's my question - since DuPage County is going to have a really personal image of the inmate - suppose the inmate has an undiagnosed issue that a trained radiologist might recognize off of these images. Would the county have any liability for having the information available and not getting the inmate treatment right away?

Not a terrible question though. There's no way they take these machines on without having any liability exposure to speak of. Now, how they do that I could not say for sure.

I really doubt they have radiologists scanning the images -- I imagine they are used more for finding contraband. I think you'd have a hard time proving intent to not inform a diagnosis by someone with no training to do so.
