Look, I'm just telling you what I think will happen at trial if you try to convict on a manslaughter charge. I think the state will have to convince a judge or jury that no reasonable police officer would use the prone restraint on a resisting suspect past the point of the suspect becoming unconscious. And that's a pretty tough argument to make when cops are taught to deal with threats as all or nothing, which is why we see things like cuffs being put on an unconscious guy that was just shot 10 times instead of immediately starting chest compressions and the like.

As for the restraint itself, again the only thing I've seen is that it isn't specifically taught at academy, and I have seen nothing to indicate that the prone restraint is specifically barred by department policy. Arguing that "if something isn't taught at academy (but not specifically banned) no officer should be doing it" seems pretty thin to the point of "can you show me where the mess hall is" from A Few Good Men.

The reason that I have said that 2nd degree Murder should be the charge is this provision which was shown:

(2) causes the death of a human being without intent to effect the death of any person, while intentionally inflicting or attempting to inflict bodily harm upon the victim, when the perpetrator is restrained under an order for protection and the victim is a person designated to receive protection under the order.

It is clear to me that this piece of shit cop was torturing that guy. HE was hand-cuffed and actually under a police car and this cop was leaning into the pressure on his neck while the guy said that he couldn't breathe. Clearly to me the cop was immensely pleased with himself.

This is manslaughter in the 2nd degree. The officer made the decision to put the subject's life in jeopardy, without the actual intent of killing him. But his reckless choice was the reason he died. I just don't believe a murder charge is going to stick. There was no intent.

I am watching a black woman chugging a bottle of vodka and others carrying cases of beer from the same boarded up liquor store. All without any cops at all on the scene. Imagine if that was your store being looted? A young white girl stealing a bicycle from another store. And these vehicles that are pulling up to these stores are not cheap either. Nice looking SUV's and Crossovers with pretty well dressed folks pulling up and then their buddies load them with cases of liquor and stuff. I also just watched them haul out what looked to be a safe that these jerk-offs were trying to break open.

And looking at the secret service being bombarded by ignorant assholes throwing bricks and shit at them and getting in their faces and trying to push threw them, makes me very angry. You know that these secret service folks could literally kill these assholes in a couple of minutes if they were allowed to but have shown unbelievable restraint.

Now the fascists in Washington broke through the physical barrier and tried to break through. And when the secret service pushed back these cowards throw their hands up so that they can be recorded as being attacked. This is clearly to me ANTIFA. Some of their leaders were the same assholes in other attacks in the past riots. These people are paid to do this.

A cop just got hurt by a brick hitting him in the face. Bleeding profusely. It interesting how antifa works. They put innocent looking women in the front lines while the people lobbing bricks and shit at the cops hide behind them. They are trying to bait the cops into reacting and hitting the women.

Atlanta finally cleared the streets and the streets are emptying while Minneapolis is burning including the Wells Fargo Bank and the Governor and Mayor haven't done shit. What a failure by this city and state. It is pathetic.
