Do you know for a fact the taser hadn't been fired yet or even could be fired at all?

The cop was certainly giving it his all while struggling with the drunk guy on the ground.

Well I know the taser could be fired because Brooks fired it at the officer pursuing him. Whether that was six shots or only five I don't know, and it would be unreasonable to expect officers to not only count their shots, but the shots of assailants as well. And even if it was a one shot taser, the fact that Brooks fired it at the officer evinced an intent to incapacitate the officer, which is a threat that warrants deadly force.

Cops are allowed to use their discretion when it comes to making contacts and arrests. Similar to prosecutors when it comes to the cases they want to try.

But yeah, if you shoot at cops with anything expect them to return fire. The officers were pretty cordial until shit hit the fan. If you dont like DUI laws then I suggest you write your legislator, these cops are just enforcing what's on the books.
