Did anyone see the bodycam video? That was literally the longest field sobriety test EVER. I've passed a few of those in my day and they don't generally ask you to blow as long as you pass the field sobriety tests. The cop who ultimately killed him was looking for a reason to give him a DUI.

I was surprised the cops had a hand held breathalyzer at all. Generally unreliable.

That's what I would have thought too. I saw the bodycam video tonight and that changed for me. He passed all of the field sobriety tests but they were unusually long. Especially the "follow my finger" test. He also sounded coherent. If I'm not mistaken that 0.10 could have been thrown out in court based on the device used IF he had a good attorney.

The first cop sounded like he wanted to let him go until the other cop arrived.

my post was not meant to question shakes on his advice i was literally asking what are you supposed to do. ive heard the same thing dont blow, but i dont know what you are supposed to do after you say no. can you refuse all tests? dont they do a blood test at the station even if you decline the field tests?

That is a good question for shakes. I know that some of these suburban jurisdictions have implemented "no refusal" weekends, usually on holidays, and it's obviously controversial to be taking people's blood against their will.
