Hang on.....he was holding a taser which was pointed at the cop and running away with his head turned toward the cop?

No it's not because he wasn't blasting away at the cops chasing him. If he turned around and pointed a gun at them that would change the analysis. Facts matter.
He turned and fired a taser at the cop pursuing him. And to save us another loop on this merry-go-round of suck: It's not reasonable to expect the officer to know that Brooks earlier fired the taser (if he did indeed fire it) earlier in the struggle.

He was turned at the cops firing a taser when he was shot? I thought he was running away and was shot in the back. You must know something no one else does.

Here is Brooks pointing the taser at the pursuing officer who has his gun drawn and pointed at Brooks. Brooks kept the taser pointed at the officer as he ran after firing the taser shot at the officer pursuing him.

I guess we have a different definition of "pointing". His back is turned to the guy and he is running away. If you think that picture justifies that cop shooting him in the back then this conversation is over because there is nothing left to say. That's what juries are for.

Pointing backwards as he runs away. Even assuming he could be accurate a taser is effective To about 15 feet. He was pretty close to that in the picture and certainly would have been beyond that in a few seconds.

 Let me just give you a chance to stop before you embarrass yourself and try to argue that Brooks pointing the taser at the pursuing officer wasn't REALLY a threat because his aim would be terrible. Just swallow that one and we won't speak of it again, ok?

Sorry Matt, this idiot beat you to it.

Yes, a sidearm is still a threat to do grave bodily harm or cause death if the shooter has poor aim. Also let's see the resolution to which you can judge distance when pursuing someone who just tried to punch you and then shot a taser at your face. It was close enough that I doubt you'd want someone shooting taser prongs at you from that distance, right?

Brooks' hand was making the end-that-goes-bang align with the plane in which the officer stood after already similarly aligning that end and making it go bang. What definition of "pointing" do you use?

Are we really arguing that a guy who pointed the weapon he took from the cop shouldn't be considered a threat despite pointing said weapon because he was running while he did it?

It's a shame that this thing escalated to the point it did, but if you take a weapon from and point it at the police there is a high probablity of you being shot.

I think policing in the future will include a laser in the squad car projecting a 20 ft circle around it known as the The Death Circle where if you can resist arrest, engage in physical combat with an officer, obtain his weapon, fire it at him then run away and get outside the circle, the cops have to wear it and you’re just free to go.

I mean maybe shakes and Franky are right in terms of the law. I wouldn't think so but I don't know shit.

Well when we are getting to where we have to argue about what constitutes “ pointing the weapon” .... I hope none of us ever has to deal with having a weapon not pointed at them like Brooks wasn’t doing.

You don't seem to grasp the concept that this is a fact intensive case and it's up to the jury to hear the facts and make a decision. It's as simple as that.

No, in that picture he is pointing the weapon. He fired that same weapon at the officer (by pointing it at him in a similar fashion) closest to him when he was about even with the left rear tire of the red car.

 Let me just give you a chance to stop before you embarrass yourself and try to argue that Brooks pointing the taser at the pursuing officer wasn't REALLY a threat because his aim would be terrible. Just swallow that one and we won't speak of it again, ok?

I think you have it backwards about who is embarrassing themselves about this.
From the "The gun in his hand was aimed at the officer, but he wasn't POINTING it at him!" guy? Settle down, counsel. Stick to policing Latin usage.

You're the dumbass who tried to use a Latin phrase to try to sound smart. Don't blame me for calling you out for your incorrect usage of it.

But a LAWYER thinks so! Not even a fake one like me!

Two lawyers. But you know better.
Which one of you is Sheryl and which one is Julie?

Like the fact that Brooks was pointing the weapon he had just fired at the pursuing officer?

Do you not understand the role of the trier of fact in a trial? Didn't Google Law teach you that yet?

What was incorrect about the usage?

I don't remember anymore. And as far as comparing me and shakes to Julie, how is your wannabe radio career working out for you?

It's up to THEM to decide that. This is the problem with internet lawyers. They don't understand the role of the trier of fact.
