A few thoughts:

The HIPAA argument doesn't really have any application in this discussion. HIPAA regulates the sharing of medical information without consent of the patient... nothing that is happening with Nisei involves this (or does any other business story which I have heard of so far.) In all of these instances, the patient is being asked directly to share the information. (HIPAA does some other things as well but those are not germane to this topic of discussion.)

The rights of a private business to reject individual access on the basis of specific criteria is one which has been regulated in many areas. Covid doesn't seem to fall into an area which would be considered a protected class, although one could easily imagine examples where this could turn into a protected class for a specific individual. My religion prohibits me from getting vaccines, therefore banning me from your establishment is a violation of the first amendment. I have a high-risk pregnancy and I have signed documents from my physicians advising me that the vaccine would be a risk to my health as well as my baby.

If Nisei isn't providing accomodation for protected classes, then they would be liable to lawsuits/prosecution under unfair business practices. Note that this accomodation could be a special room reserved for those that are not vaccinated -- it doesn't have to be exactly equivalent to what a regular customer would receive. Their biggest concern should be accomodating their own employees, as employees are in a protected class and mitigation would have to be provided for those working with the non-vaccinated customer group. If Nisei were found to be negligent in that, an employee could bring a meritous lawsuit against them.

For the person who asked whether screening for PReP would be an equivalent -- it is a little bit more tricky because sexual orientation has become a protected class. Most straight people do not take PReP. Persons assigned female at birth are not eligible to take PReP. You have a few issues here that more commonly affect protected classes -- a vaccine doesn't have that same targeted impact.

If you had the virus, you don't need the vaccine.

MANY others had it with mild symptoms, and have the antibodies.

The amount of deaths to those under 65, is less than a bad flu season if you believe what Fauci said in his emails.
