Legal, probably not. Ethical? I don't think that's at play here.

MANY stories that are in the public interest are not always legally obtained. That's why the First Amendment is first whereas "criminalizing the receipt of information that may have been obtained illegally" is not found anywhere in the Constitution.

JLN and the Biden admin can find common ground in viewing folks like Julian Assange and Edward Snowden as arch criminals.

So any information obtained on a public figure is fair game for publication? Nick Denton could've used you on his legal team.

I think you’d agree the journalistic value here is different than when Gawker published a grainy video of the Hulkster railing a shock jock’s wife.

Considering the only qualifier in this instance appears to be the public has some right to know about what REALLY rich people report to the government on their individual returns, I'd say the journalistic value is about the same as who the Hulkster porks.

How rich can a person be before their tax returns become fair game for reporters to seek out and publish?

These are more than really rich people. They are more powerful than most elected officials. They have an unnatural amount of power and influence over the government. So slightly more a part of the public discussion than Hulk Hogan's sex tape. Though that too was an interesting legal case.

A quick google tells me that the lack of asking for comment from the subject pre-publication doomed Gawker. That seems to be a journalistic get out of jail free card that ProPublica played here.

Very odd to see a person who on one hand bemoans the silencing of controversial speech by Twitter and Facebook, but on the other has no issue with Peter Thiel bankrupting Gawker because he had beef with Nick Denton.

And no, I do not think Hulk Hogan's sex tape was in the public interest. So no need to make that argument.

Have I argued that the tax filings of Facebook and Twitter aren't in the public interest?

Yeah you know me, I love Bezos and Soros (in the mornings!). It has nothing to do with not liking the precedent set by journalists obtaining unlawfully conveyed personal, confidential information and indiscriminately publishing it because they think the people have too much stuff (and for no other discernable reason).

Eat the rich! Wealthy people are in no way redeemable or admirable!
