After viewing a police video of the incident and hearing testimony of witnesses, a Cook County Circuit Court judge Wednesday ordered the case dismissed and Telander’s license returned with no fine or penalty. The order cited “failure to have reasonable grounds to believe defendant was intoxicated.” Telander, 72, had been charged with driving under the influence of alcohol, disregarding a traffic control device, speeding, improper lane usage and operating an uninsured motor vehicle. He did not respond to a request for comment.

nothing fishy about it. DUI's are not that easy for the prosecution to prove and there are a lot of technicalities the cops can screw up during the traffic stop. This is why you always get a lawyer if you get pinched.

You would know more than I do, but It seems to never get thrown out this quickly....you get charged and there's thousands spent on an attorney to get a Nolle Prosequi, which stays on file. It also remains visible to the police if they ever run your license in the future.
Never had one, but have known plenty that have been through this.

I get this. But I thought that even if you get a lawyer and take their advice not to blow the DMV gets you anyway. They suspend your license administratively for the refusal. Even if acquitted.

seems like somewhat of a trade-off...if you don't blow and take the civil hit it sucks, but then trying to convict on the DUI charge without a BAC reading is a lot harder

I appreciate you setting the record straight about the improper DUI charge I was given a few weeks ago, which was thrown out by the judge for being wrong.

I just want to make sure people understand that ALL the charges brought against me — including disregarding a traffic signal, improper lane usage, speeding, and no auto insurance — were also dropped.

All were wrong. Every one of them.

The 2021 insurance card was in my glove box. The police’s own video disproved the other charges.

I just want to make sure your readers know. I think it’s important. It certainly is to me.

Seems like auto insurance is pretty easy to prove/disprove. I know you are allowed to show in court that you have it but just didn't have the card at that time.

But, if it was in the glove box, why would they bother to write him up for that? Was not able to look open the glove box?

Every time I leave Da Jewels I see the newspaper rack on the way out after the cashiers with the ice and firewood.

I look and think I might have bought a paper if I'd seen it before I paid for everything but I'm certainly not going to turn around buy one.

I haven't bought a newspaper in years and when I do it is to load the grill chimney to burn. I was a newspaper guy.

Why do they even bother? I think I bought a Sunday paper for fire kindling a couple years ago and it was like 5 bucks. I didn't realize at the time but I was thinking that was expensive kindling.

Telander claims the Wilmette police were wrong on all charges. He didn't clarify anything. Only reiterated what was known already. I'm thinking he went for the package deal that the video disappears. Must be nice to be rich. 91% of people in Illinois arrested for DUI lost their driving privileges.
