If im salary, exempt, and they dont pay overtime... Can they dock money for working less than 40 hours? Dont think so, but then i see theres a classification of salary non exempt, whatever bullshit that is. I will know next week im leaving early every day this week out of spite. There is a legal minimum salary where companies still have to pay overtime. Think of a person running a McDonald's restaurant that works 80 hours per week but is paid like $30k. I suspect that is what they mean by salary non exempt (exempt being from wage andf hour laws). That threshold is just above $35k now.

Normally if you are salary exempt, you get paid regardless of how many hours you work. I actually do not know if they can legally pay you less if you work less than 40 hours. I am not aware of anything to prevent that from happening, but it seems shady since they cap you if you work more than 40.


As for working on my estate, I can handle my two acres well enough on my own. lol

i work in payroll and this is correct. the only situation where a salary exempt employee is going to receive "less" than their salary, (even though it really isnt) is if you say are set to receive a salary of 80 hours each payroll and you take 8 hours vacation. Most companies have the paid time off code set up to reduce the salary to be 72 hours and 8 hours PTO in this situation. You receive your full salary, but the hours are reduced to account and keep it at the full payroll as opposed to 80 hours + 8 additional.

My last job was salary exempt, but they did stipulate you have to be on site 1 hour in a given day to qualify for a full days pay. Not even sure if thats legal, but these days whos enforcing it?

This, it's all or nothing for swapping out a PTO day for missing work. Either you use an 8 hour PTO day off or you don't, no partial docking (heh-heh) among exempts. (or whatever your work day is, 7.5 is popular nowadays).

At the end of the day, if you're a valued employee who gets the job done, you can probably do what you like. If you're a lackluster employee no one would miss, NBC.
