My apartment is in a building that has 24 three-bedroom units, 48 two-bedroom units, 48 one-bedroom units and 48 studios. I own a three bedroom unit. The three-bedroom unit owners have more votes than the two-bedroom owners who have more votes than the one-bedroom owners and so on. But some of the Orthodox families with a lot of children are trying to change the rules so the votes are based upon how many people live in each unit. Am I wrong for objecting?

I assume votes are structured that way based on how much each unit is valued (with three units costing more)? Or maybe the three unit spaces collectively take up more real estate. I don't know. I also feel like this post is trying to open up a larger electoral college vs popular vote debate so maybe I should just cease commenting until I see which side is winning.

Honestly, the way the rules appear to be drawn up as described in your first post make the most sense. It should have zero bearing on the situation how many people are living there. Is there something in particular a higher head count and more votes would allow a group to change at the condo?

I'll defer to you on Illinois Civil law, but certainly from a policy perspective it makes sense. If the building is going to have a special assessment for a communal need (roof, plumbing, etc.) they are going to assess the owners based on square footage, so it only makes sense that the owners who will most bear the burden of a vote to enact an assessment should have more voting power.

Tell your neighbors that if they will make assessments for projects based on the number of people in each unit, then you'll be willing to discuss voting by head count.

Also, square footage is essentially a fixed and determinable standard. The headcount per unit can change on a daily basis or be manipulated. For instance, if you knew that a vote was upcoming, you and your wife could just ask Jean Jacket Joe to "move" in with you guys to get a third vote.

You're correct. But this particular situation explains in part why I don't ever want to live in the air rights of a condo.

And that wasnt 75 percent of votes received. It was 75 percent of owners. It was impossible to get 75 percent of the owners to do anything especially a minor change.
