You're better than this, CH. You viewed him as a danger to you solely because he's an other. Anyone on a narrow and crowded platform is potentially a problem. The crackhead was probably the least distracted person around you.

Society gave them those spaces a long time ago, and it's illegal to round them up if they haven't committed a crime. I would argue the asshole kids have always been a bigger problem on trains, but we still see them as people.

Typical charge in this case would be at least 2nd degree, cuz they'd be angling for you to plea out to manslaughter. not much room to negotiate down from manslaughter.

Although I guess the argument would be that it's easier to get a jury to convict for a manslaughter charge vs 2nd degree.
Maybe that was their thinking. I dunno.

I think the real question should be, how does prosecuting this guy serve society? Are we trying to punish a guy who stood up to a known criminal who was threatening people on a train car? Are we hoping he is acquitted so dopes can start rioting in large cities across the country? What is the point of prosecuting the guy? Do you think he was trying to kill Neely? He's been compared to Bernie Goetz on this board. Do you think he started his day hoping to run into some madman so he could kill him?

I think the point is that if he was justified in his actions he gets a chance to prove it in court.

The 15 minute chokehold is going to be a challenge to explain if that is accurate.

Yes. That is what the trial will be for. The prosecutor will try and prove it wasn't justified and the defense will try and prove it was justified. That's why he was charged.

Technically, the defense doesn't have to try and prove it was justified based on the most basic "innocent until proven guilty" argument but that also would be a very poor choice by his defense to not provide a defense.

I think that is a different discussion but clearly a lot of people who should be charged with crimes are getting away with little or no punishment.

It's nice to be "compassionate" until one of these nuts comes at your family member. At that point the reason for the guy's actions go right out the window and you start praying there's someone with enough guts to take that fucker to the floor.


Again, you're saying his life has no value because he's mentally ill. Not long ago, you were of the belief that your neighbors had ostracized and dehumanized you solely because you chose not to get an experimental shot or walk around with a mask. That angered you.

If a mentally ill person yelled at "my daughter", I'm not going to try to kill him or her. I don't instinctively see them as a threat solely because they are a societal other. The same would be true if you did it. As I said earlier, no one would be cool with one of the MANY asshole kids or you or I getting choked to death for being loud and obnoxious. Something about the first amendment may be mentioned.
