I think the only reason Fox settled that case is because they wanted to prevent a lot of embarrassing stuff from coming out via discovery. Some of it came out anyway. There were obviously issues with the Dominion machines.

As I said at the start, the blackface portion was libel. I mean, maybe a Deadspin lawyer can be like "Well, it was black paint, and it was on the face, and my client was simply describing the color" but I believe that one guy also mentioned "two groups" or something like that.

I'm sure that's the position his attorneys will take.

Again, if he wrote "in my opinion wearing black and/or red face is a sign of hate" that's his opinion and not actionable. But that's not what he wrote. He didn't exactly say that though. He said the kid "found a way to hate Black people and the Native Americans at the same time." Is painting half one's face red and the other half black a way to do that? I don't know, but I think in today's climate it's fair to believe it could be.

If wearing blackface isn't "hate" why is it so taboo? So then he has to argue that he wasn't wearing blackface. I don't think he was, by the way, but I think Phillips is entitled to the opinion that he was.
