meatpants, why won't you guys devote a segment to this story? I'm pretty sure this is bigger news for the people who listen to sports radio than another mid-June Cutler story. Channel 5 led off with this on the 10:00 news, that should give you guys a clue how big this. When you guys discuss what you are going to talk about beforehand was this even discussed?

To me, this seems like it is obviously the #1 sports story in town right now. Actually, this is even bigger than the Cubs/Sox weekday series between two mediocre underachieving teams. How bout tomorrow you guys make up for today and spend a sold half hour at least talking about this. I think you'll be surprised at how much interest it gets from the listeners.

You know, I'm pretty sure some media people read this board and while several stories have mentioned BeBe's now-infamous "Google search," not one single person has called them out on this by mentioning that some schmuck on a message board--namely, me--found the story of DH's prior conviction AND records of his 3 bankruptcies in a few minutes for $4.

I think there are still people in this town that are afraid of making North look like a fool.

The purposes of employee background checks are many, and searches are ordered for a number of different reasons. However, they are mainly done to ensure that a prospective applicant has a clean criminal record and will not be a problem employee or a threat to the security of the company or other employees. The employee might have access to your assets, your clients, your money and even your reputation. A bad hire could put you out of business. Employers now have access to all the information they need about a prospective applicants past to make a formed decision. Therefore, the bottom line is a background check makes sure that the employer is making the safest hire possible.

The following statistics are provided by ADP:

30% of all business failures are due to employee theft and related forms of dishonesty.


Another major purpose from an employer to conduct pre-employment screening on prospective employees are the rampant legal issues that companies face in the wake of hiring a problem employee. Every employer has a legal duty to exercise due diligence in hiring. Employers can and will be held legally and financially responsible for the actions of their employees. In many states the courts have determined that it is the responsibility of the employer to conduct pre-employment screening on prospective employees.



Generally speaking, a jury decides if an employer is negligent by using the "reasonable person" standard. Even if the company had no knowledge of criminal history when hiring an employee, they can still be held responsible should anything negative happen. If that employee attacks a co-worker, for example, and it turns he/she had a criminal history than the company may be held legally and financially responsible. In other words, the employer should have known that the employee was dangerous because they should have conducted a background check, thus, can be held responsible. Often times the employer will come up on the losing end of negligent hiring lawsuits, in fact, the numbers are around 70%. Also, a simple internet search will show that the average award in these cases is over one million dollars. For employers, here is the question. If your firm is sued, can you show due diligence?

I'm not even saying the Norths will face charges because I don't know that, but I would assume they would at least be asked to testify at any proceedings against Hernandez.

After thinking it over, I have my doubts that all Team North did was a Google search as a background check on this guy. It's a nice CYA story, it doesn't make sense otherwise. If Hernandez hadn't ponied up the cash, what was Mike going to do? I'm thinking they just turned a blind eye to Hernandez.

I'm an attorney (i know, i know its shocking....but I didn't say I was a good one) and I've had a couple cases where we were successful in going after an employer who didn't do a background check. In both instances we sued for negligent hiring and won. But, the difference is that in those cases the standard put on the employer was very high because the employee in question was given a job that put him in a position of trust within the community. In one case, an absolutely horrific case, we sued a landlord for not doing a background check on a maintenance man who later it was discovered had been to jail for sexual solicitation of a 9 year old. No one bothered to check into his past and then they hired him and gave him keys to everyone's apartment. In my case he ended up sexually assaulting a 5 years old boy after letting himself into the apartment to fix a set of drapes. The mom was in the bathroom and the guy let himself in and molested the child. The law states that because the maintenance guy was given keys to apartments the landlord had a greater duty to do a background check.

A similar and even more unbelievable case involved a trucking company being held liable for not doing a background check on a driver who later picked up a hitch hiker and raped her. It was held that because truck drivers are known to pick up hitch hikers the company had a duty to the public to do thorough background checks on all drivers.

Now, in light of the severity of those cases I doubt North will be held liable for not doing a thorough background check.

Good point. As much as I think it would be great if North could get dragged into this, the google search angle probably isn't going to be the reason.

Now if North knew the business was all a scam at a certain date yet continued to go about business as usual and even went after new clients/possible employees that might be a different story. And if you listen to North, it sure sounds like he is claiming he knew this was a problem for a while.

That's what I'm wondering as well. Didn't Huebner say his checks were bouncing since April? Surely North knew about that and yet still went and hired new talent.
