Which is also why they were well paid and under two year contracts: the whole thing was pretty risky. All of them were paid for the risk they were undertaking.

Should Webio come back, one thing for certain is, the Norths won't be running the office. Just on-air talent.

From an Ed Sherman June 16 "Crain's" article:

"I want to stress Mike, BeBe and Jeff did nothing wrong," Mr. Rogers said. "I worked closely with BeBe and we went to David if we needed to get anything approved. A computer, travel. All they wanted to do was build something here."

Jesse says he worked "closely with BeBe". Those must of been some great conversations. Hey, Jesse is standing up for them. That should be enough to clear them. If he says they did nothing wrong that's good enough for me. It's Jesse Rogers for the love of God.

North is only a target for the same reason one of you bozo's said that Comcast should have been a target. cause he's rich and he has money and influence and you people just want an innocent man to suffer.
this Fonzie scheme has been going on a lot longer than North has been around That mexican fella. He's been taking money for months and months before he did any deals with North. North just thought he was a wealthy guy who owned a company and liked North and his product.
this suit is nothing more than shit against a wall, but none of it sticks, sources say that both Norths will be dropped as defendants very soon.

Wrong asswipe. Your beloved Pappy has serious problems that will be very COSTLY for him. I hope he goes broke and run out of town. maybe he can go live in one of his empty Vegas condos that are now worth 1/2 of what he paid for them.

This is what we've all been saying. Finally a lawyer is gonna say this in court before a jury. This really looks like an open and shut case to me. It's just a matter of how much money they'll get. Is it just the "bad money" received that is taken back? Or could a jury go above and beyond that?

Maybe we should put together a letter to the lawyer with all the good stuff we can dig up and have dug up and help the scam victims. Kind of like a "fund raiser" for the victims. I hope they get every penny from North because Hernandez has nothing to get.

So should your dumbass clients! Ya know, the idiots who willingly handed over close to $100,000 to some guy who apparently they knew nothing about.

The husband and wife who blew the whistle on alleged Ponzi-schemer David Hernandez filed a class-action lawsuit

wait a sec, Mike North sued himself????

More than half of the people getting sued in this lawsuit will be safe and have their names removed from the suit by a Judge, but for David Hernandez, the troubles continue. Expect more of these types of suits to pop up over the next few months, too.

North, Jiggetts and any named defendant in this case are in some real shit.

First off, the suit will seek class action status for all plaintiffs (should not be a problem)

next North and Bebe are in some shit because in their role as officers they have a fiduciary duty,

Directors of a company owe such a duty to their shareholders. Crichton v. Golden Rule Ins. Co., 358 Ill.App.3d 1137 (5th Dist. 2005); and Illinois Non-Profit Risk Management Ass'n v. Human Service Center of Southern Metro-East, 378 Ill.App.3d 713 (4th Dist. 2008)

Now what can happen is that the class of plaintiffs can joinder the parties (placing the class action plaintiffs against the norths, david hernandez and all other defendants). go to trial, win a judgement for damages (including punitives). Then they can go after the norths for the entire sum, leaving the norths to go after hernandez.

bottom line, the norths are in some deep caca, jiggets and the othes may lose any money that they made in the course of their contracts as the ill gotten gains, but i dont see them as defendants due to the fact that they do not have a fiduciary duty to the plaintiffs (as mere talent on the webio thing).

Not to mention there is a possibility of filing a civil RICO action against the entire entity. But they arent my clients.

later

sabu

Hey Sabu, not my area of expertise (I do work comp), but would that law apply to North since he is only an officer in Webio, not the actual parent company. It doesn't appear as if Webio had any investors and only brought in about $3000. Also, if it does apply, wouldn't he be exempt from this suit since the plaintiff invested all his money prior to North becoming a partner?

If anything, wouldn't the list of people North could possibly be held liable to be limited to people who lost money/career opportunities as a result of webio?

Personally, I'm tired of the story now...

Let justice be served, whatever the results.

Lets MITM continue to exist or crash and burn based upon the show's ratings.

One things for certain. Mike North isn't as 'streetwise' as he thinks he once was.

I doubt that North, with all of his cash and bluster could even afford the legal fees to defend a class action lawsuit by all of the screwed investors who invested with Hernandez and his phony baloney scheme. I would think that they would joinder North (the deep pockets theory). North had better look to declare bankrupcy and get his money to the Cayman Islands.

North, Jiggs, et al could be looking at a fraud case based on what the board says that they have been saying on the webio and on their tv show. Comcast could be brought into a civil fraud case brought by investors who could argue that they relied on the statements made by Jiggs, North and everyone else to their detriment by relying on the false statements in terms of their investment. It sounds like that would not be to many persons, but one never knows.

I'll bet North goes on the cheap with a lawyer. He still probably doesn't think this is a big deal. He's got money but he's not super wealthy. This could get real ugly for him.

Great points. Just as North could be in trouble for not doing his due diligence (at best, deception at worst), Comcast could be in trouble for not vetting North (and Hernandez). In the grand scheme of things, North isn't that wealthy, and legal fees could ruin him. What's his next job?

Yeah, that's the problem. It sounds like everyone who lost money with Hernandez did so before Webio was formed.

The only thing North is probably gonna end up being on the hook for in these investor lawsuits is the wages he was paid by Hernandez while working for Webio under the "ill gotten gains" theory.

On the other hand I would be very interested to know if the webio employees who left established jobs as a result of North's recruiting have any sort of case?

North's defense; he should never be associated with anything to do with "class", action suits, notwithstanding.

Mike North has already been proven guilty of being a loud mouthed idiot beyond a reasonable doubt in this Court.
This board is a barometer of the thought of the true die hards who pay attention and listen to the sportstalkers........
Despite all of North's efforts to extract revenge on WSCR and somehow convince himself he is still relevant.....his relevance is now linked to David Hernandez.
Hey, he can commute from Park Ridge to Rockford for his next gig in radio.
