1. I'm on the other side so don't know for sure, but defense attorneys charge hourly and rates can be anywhere from $200-$400 per hour. And it would all have to be paid in advance via a retainer. I would imagine he would have to bring at least $5000-$10,000 to the initial meeting with the lawyer just to get the ball rolling.
2. Its the same case, but they are both defendants. If they were smart they would each higher their own attorney. They had different jobs at Webio and when push comes to shove, it may end up being a conflict of interests for one attorney to represent both, i.e. if one of them has to testify AGAINST the other. And honestly, I'm not even sure if its allowed for them to represented by the same attorney since they are being named individually and not as a family unit.
3. With all the depositions and discovery that will be involved in a case with this many parties you could be looking at several years easily before the trial starts. Even simple trials with 2 parties usually take 6-12 months before going to trial. But, then again this is federal court so things might be a little different than what I'm used to at the Daley Center.
