I think a case could definitely be made that it is indeed slander, young law student.

We have (1) a statement, (2) that made a claim (i.e.that he has skeletons in his closet and that he is a hypocrite), (3) expressly stated, (4) implied o be factual, and (4) that may give an individual (Mac) negative image.

Tom Cruise would have his opponent belly up in the courtroom with this much material.

I think the vague way he said it would keep him safe against slander.

Couldnt he say he literally meant "Macs backyard is not properly maintained"

Maybe thats slander in and of itself.

What would be the level of disrepair a backyard in Indiana could be in order to be considered not properly maintained?

I have actually won a slander case before. I cannot tell you too many specifics, but it did involve comments made on a radio station about a Chicago Businessman.

Ok, let me couch my definition of "win" - it never went to trial as the Defendant paid a hefty settlement to make it go away. :wink:

What is he alluding to with the "backyard" comment?

Is he implying that Mac is hiding something or that he truly has a messy backyard area?

Like I said, many defenses exist to a combat a claim for slander, but (without actually hearing the excerpt, of course) elements seem to exist such that a complaint could be drafted and filed with the court that could be argued behind or possibly survive initial challenges.

Therefore, a "case" could certainly exist.

I am a practicing lawyer and I have seen much stranger appeals for civil justice.
