This will be very interesting. Unless my "Earn a Law Degree By Mail Grad Cert" is wrong, this sounds like a classic non compete clause for any type of business that you might sign a contract for.

Notice the way Damneal was terminted. His agent was smart enough to get Mac paid during his non compete period.

I do understand the difference that Murph was not fired but just not renewed and he should have not signed the deal in the first place.

I do know some different laws exist for Personal Service contracts and I always thought the non compete was legal, or maybe nobody ever challenged it because they wanted to get another job? and Murph decided he wa done because nobody will hire him, so he chose to sue.

Cant believe that none of you picked up on the Class Action part of the suit of "others who have been prohibited to work that have left CBS since 2002"

Who would that be????????????????????? NORTH!

Isn't North different than Murphy? Murph got fired with 10 months left. North's contract expired, they offered him 800k, he turned it down. They let him go a month or so before the contract ended but he was free and clear after that. He got webio and Comcast in short order.

This shit is like office leasing and renewals and ROFR (Right of First Refusal)

While Mac's deal may not have read "Non compete", he had an OPTION that ESPN needed to exercise or say good bye, by January 1 (not sure on the exact date) as his deal then ran out by May 31.

The part of him being taken off the air, I assume was well within the power of ESPN as long as they paid him, which they did. So the 5 months that he did not compete or even talk, he was being paid, I assume unlike Murph.

Non compete clauses are usually included in the sale of a business, so the day after I sell my Taco stand, I dont take the money and open another Taco stand right next store.

I also wonder if Muprh ever asked to be released from his non compete clause? or ever asked to be compensated for it at the time he signed his deal? I would think that if compensation is defined for this right, Murph is screwed and is just trying this route because nobody will give him a gig, which kind of shocks me that WGN hasnt stepped up.

I don't think Murph is gonna win. He's just giving it a shot. What the hell? This "Class action" thing won't cost him anything to file. I get shit like this in the mail telling me that I can win some class action bullshit. I always throw it out. Lawyers just try these things cuz they get a % if they win.

I also think Murph is bitter at the SCORE. He's also angry that "Team Bernstein" still takes shots at him even after he's gone.

In the aftermath of Mike North leaving the Score, didn't he claim one of the reasons he couldn't get broadcast work was because of his "non-compete" agreement? And wasn't it pointed out by those in the know that he was full of shit because Illinois banned such agreements in the broadcast industry?

Had some Sushi and Lou Malnatis (I was at a party) with an employment attorney and asked her about this scenario.

1. NON COMPETE are Legal in Illinois! So Much for the "Illegal" part

2. The theory of how reasonable the non compete is, can change this ruling. Thus a written contract for thus non compete can be challenged, with the burden going to the employer defining what they are protecting by doing this?

I would argue that if Mike Murphy had ratings, which he did,WSCR is protecting their Ratings by not letting Murph go somewhere else right away and take those ratings. What if Murph just chose to leave when his deal was up?

I dont think Muprh wins this one or settles on it.

Murphy’s agreement banned him from working in the market for six months after leaving CBS. In 2001, the state legislature passed a bill, championed by the American Federation of Television and Radio Artists, outlawing non-compete clauses in broadcasters’ contracts.

WSCR took him off the air - but if they were paying him - then he's SOL. Eddie and Jobo and Dahl both got paid (or are getting paid) to sit on the sidelines.
