Yep.

Even if he WAS planning to opt out but had not as of yet and the Cubs contacted him, it would be tampering.

When Friedman left it triggered a clause in Madden's contract in which TB needs to notify Madden via his appointed agent as to the fact his 14 day window has opened up of him being able to opt out.

While the chance exists that the Cubs happen to be aware of this I would just guess it would have come from 1 source, Madden's agent, who has been doing this for 25 years and should know what is considered tampering or not.

Of course when the decission is made by Bud about what is tampering and he calls Jerry.....Ohhhh wait....that isn't going to happen anymore.
