The NFL told the Bears player's money can't go to a business entity other than the player, per the report. There was no reason given for why the league axed the idea of a forgivable loan.

The clauses Williams' team pitched could've been historic. No rookie NFL player has ever notched a clause in their first deal to exclude the prospect of a franchise tag from the future. And no player has ever been paid in the form of an LLC or through a loan

The loan thing is an obvious cap circumvention and that had no chance of getting approved. The LLC thing is interesting. So in theory any of us can incorporate an LLC and if we can get our employers to pay the LLC we don't need to pay Illinois income taxes?

It sounds like a plan hatched by writers in a sit com meeting.

Williams didn't use an agent because rookie contracts are boilerplate. Then he proffered non boilerplate conditions that would have been aided by having an agent. It's like when that guy who ran over all those people at the christmas parade in wisconsin represented himself at the trial.

Why would have they been aided by having an agent? He has a former agent on his team, IIRC. He would have paid an agent 1-3% just for the NFL to say no. He's still paying a lot of lawers, so you should be happy, my friend.

I would think the LLC would still have to pay income tax or distribute the money to an individual who’d have to pay income tax if they’re an S corp.

Unless he’s routing all of his expenses through the LLC, I don’t get how it’d help him that much.

That said, I’m supportive of him doing anything he can do to reduce his tax bill.

I assume the idea was that he would form an LLC in another state, have the Bears pay the LLC, and then he would pay himself in another state from the LLC and avoid income tax in anywhere but the state his LLC is based.

But, as someone with some experience with LLCs, this is a good way to have long conversations with the IRS or whatever the Illinois IRS is called and to find yourself going down the Wesley Snipes path.

I think that is what he was trying to avoid but that's also why the state of Illinois would be very interested in the reasons why an LLC from a tax-free state was being paid by the labor of Caleb Williams.

He should have learned the Chicago Way and had the Bears pay a contractor to build him a house off the books as part of his compensation package...or give him use of a private jet and stay at the Four Seasons to scout Tahiti for prospects after the end of the season
