It seems to me that if you paid for the sandwich and ate it without registering any complaint about the sandwich measuring less than the 12 inches it's supposed to be, that you are S.O.L. at this point. How can it be proven that any sandwich that was previously eaten, was in fact undersized? The guy that measured his sandwich and filed the lawsuit has a case. But all those that failed to ascertain the exact size of the sandwich prior to it's consumption, probably are going to be excluded from any class action lawsuit at some point. It has to be shown that each member of the lawsuit was in fact the victim of fraud.

And, really, just like a "Quarter Pounder," being a burger's weight prior to cooking, couldn't Subway just claim it was 12" when we made it, but in wrapping there might be....erm, shrinkage?

I mean...no. Considering you watch them make the entire thing, and a healthy percentage of Subway's sandwiches aren't "cooked" by any method.


Their bread is rather soft. I'm pretty sure wrapping it in wax paper then shoving it into a glorified newspaper delivery sleeve will knock it down in size.
