The poll is flawed, in that there is no option to share the blame in this unfortunate situation. Thr Pastor's notation (unless the service was poor) was uncalled for, not to metion stupid-since it wouldn't remove the charge. But the server showed extraordinarily poor judgement in posting those notes and I can't really blame Applebees for firing her to avoid the backlash from people who are offended by the server's actions that may have caused embarassment to the Pastor. I don't mean to say that the Pastor doesn't deserve to be brought down a notch, but it's understandable that Applebees wouldn't want to lose business over it all.

I supposedly met "God" or well... "Jesus' father" outside the Howard redline station once. He was black, exactly my height (we saw eye to eye) and he bummed a cigarette off of me. B4 I met him people were seemingly waiting for me downtown to congratulate me on "making it" and then telling me I could have whatever I wanted, and when I left the station other people were waiting for me asking if I met Him and what I thought of the whole situation.

From what I could gather, He is a funky/looking black guy who doesn't have much money and marvels in randomly riding the subway in the middle of the night enjoying his creation. Seemed legit to me. Ergo, prolly not much of a tipper. We'd all be so lucky to marry all gore.

As for the pastor? Shrug... shitty tipper... what can I say?

You didn't read any bit of the thread, did you?

Applebee's, or any restaurant, CANNOT CHARGE more than what a patron signs for on the check. So essentially, but writing in the amount of the food only, and then signing it...effectively canceling the gratuity.

If the customer were trying to short the actual bill, the cops would do something about it. In this case...there isn't much that can be done besides banning that lady from coming back.


This is incorrect. If the customer is made aware of it ahead of time then they are obligated to pay it. When it gets dicey is if the policy is not posted or is inconsistently applied.

If I counted correctly it is a total of three cases that were tossed in court. And the articles point out that the plaintiffs' legal fees cost them much more than the gratuity.

Google also returns several instances where police were called after similar disputes and they sided with the restaurants.

Dined with a large group yesterday for lunch at the Olive Garden...checked the menu just for this policy since I was curious, and it said "For groups of 8 or more, an optional 18% gratuity will automatically be added."

Putting optional in there is dumb.

I think once it ceases to be optional, it is no longer a gratuity.

This is correct. You can get the cops called on you and they will arrest you. Now, maybe you'll be able to lawyer yourself out of it but that doesn't mean it's legal to not pay it. People lawyer themselves out of all sorts of things but it doesn't mean that the next person up isn't doing something illegal.

It's illegal without question. The thing is that most businesses aren't going to take the time to fight it because it's bad for business to be pressing charges against customers and not really worth the time.

But hey, if you are willing to risk getting arrested so you don't pay 18% more of your bill go ahead. I'd recommend talking to the manager, who will likely lower the percentage. Even bad service deserves some sort of tip.
