i know for sure you can blow under .08 and still be arrested for DUI
I'm assuming they probably still COULD arrest you at 0.00, probably just get thrown out in court by any lawyer with half a brain
Fortunately, most departments today have dash mounted cameras and the officer directing the suspect through a field sobriety test, will do so in full view of the camera. Then, the evidence of how well or how poorly he/she performed in those tests will be recorded for use at trial. If a subject has performed poorly in their sobriety test, and has slurred/irregular speech and seems incoherant/confused, all that will go a long way at trial in gaining a conviction.
