We put the "Cracker" in Cracker Barrel. You might be a redneck if you think "loading the dishwasher" means getting your wife drunk!

I'm trying to understand your post.

Are you saying that he doesn't have rights by virtue of the 1st amendment to say what he said?
Do you really not get what lipid is saying here Seacrest? You do understand that this isn't a 1st amendment issue right?

If his contract doesn't stop him from speaking his mind then that would be why would be my guess.

No, that's why I asked him the question Zippy. I have an ancillary knowledge of the issue from driving through the south last week. And I have never watched the show at all.

Do people go to jail all the time for speaking their mind and I am not aware of it?

What the hell are you talking about?
He's facing no legal action, I.E. the first amendment has protected him.
However, the first amendment offers no protection from employment ramifications. Therefore, the first amendment has no bearing on this case at all.

I can't understand why so many people don't understand the bill of rights.

I hate when non militia members use the 2nd amendment for gun rights ownership.

Yet another fundamental misunderstanding of constitutional law. I recommend you read Heller v. DC or McDonald v. Chicago.
You wouldn't be a very good lawyer. You shouldn't try to play one on the internet.

Hey, but he did stay at a Holiday Inn Express last night!

Is it me or are average joe's really confused by our fundamental rights?
Whose fault is this? Our schools? Should High Schools and Elementary Schools have done a better job explaining our basic rights? Do those rights conflict with current government philosophy?
Our Supreme court has affirmed the individual mandate of the second amendment. Is it the fault of the founding fathers to not have used simplistic enough verbiage for the common man to have understood? Is it the fault of our educational system for not having taught us how to understand this verbiage?
Our first amendment provides that congress shall make no law abridging the freedom of speech, but it lay out no prohibition of private consequence thereof... yet our population misinterprets this as a freedom to say whatever one chooses with no consequence, which as we know is not a right guaranteed. Why do we have this misunderstanding? Who is at fault?
We regularly toss aside our 4th amendment rights. We don't even understand that a cop can't just go thru our cell phones to see if we were texting while driving or look thru our trunk because we're conditioned to believe that if we have nothing to hide we have nothing to fear, but as we lose our respect for the 4th amendment we lose our ability to enforce it simply due to the fact that we obeyed the law and had nothing to hide?
Who is at fault for these horrible molestations of our constitutional rights? These misunderstandings that ultimately lead to our loss of freedon?

Nah, I don't think many laypeople know that the Bill of Rights provides no protection in a private setting.

However, it is not unadvisable to use it's verbiage as a general guideline.

Things are really coming to a head, though. If we did have a Civil War, I wonder what the sides would be.

Shouldn't we have taught this to our children? Isn't the Bill of Rights like the most important document in American history?
Its a big problem that people don't understand it. We're giving away our power to the government... specifically in the instance of the 2nd, 4th, 5th and these days very much the 10th amendment as I believe the significance of States Rights is largely being undermined by the Feds.

THe schools have an agenda, they don't want your kids to know these things.

I'm not really that smart. But I am two for two in civil cases working pro se.

Amendment II

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

So the right to keep and bear arms is not tied to a militia?

It is absolutely tied to it. Citizens have the right to bear arms, specifically because they wanted citizens to have the ability to form a militia.

Back to the first amendment... are you being serious, or are you trolling? I honestly can't tell.

So do I have the right to bear arms if I have no intention of joining a militia?

According to the Supreme Count, no, it isn't. That's all the really matters on the subject. Doesn't matter what you or Darkside might think either.

You never know when the people may have to raise a militia. For example, what if some overreaching executive and his friendly Congress tried to impose a healthcare system that the vast majority of Americans didn't want? How do you expect the people to revolt without weapons? The forefathers, in their infinite wisdom (and being seditious motherfuckers themselves), had the foresight to include a provision in the Constitution specifically for such inevitabilities.
