So, I'm at a complete loss as to how this means, literally, anything to speak of.

Aside from the fact that this will be appealed forever, and that they'll still have that dopey logo and all that crap via 'use', how does this provide any disincentive to change the name/logo/whatever? Plus there can't be that big of a "black" market for racially-tinged jerseys and t-shirts (I have to assume knock-off jerseys are a no-go because those are NFL branded).

The thing is that the Redskins now have to go into a court of law and prove it isn't a slur. They open themselves up to Snyder, or even Goodell having to take the stand and give testimony. That is a public relations nightmare but an even bigger one would be not appealing which would mean that they do accept that it is a slur.

The only way the Redskins can really keep the name now is:
1) Make a convincing argument it isn't a slur.
2) Dig in even deeper at major public embarrassment to the league.

They could simply go on as they are and ignore losses from those that infringe on the previously TM'd things.

The problem with that is that they would be acknowledging that it is a slur, which is the worst possible outcome for them and the NFL. Their whole argument has been that it isn't a slur.
