I'd been thinking about paving my driveway for some time now. Bob, my neighbor across the street, whom I trust completely (he's always been totally awesome to us, very helpful, friendly, we watch each others houses when we're on vacation and collect each others mail when we're gone, stuff like that) knows a guy who owns his own paving company and he was having him repave his drive and Ron, the next door neighbor's as well (that guy has two drives). I guess Bob was good friends with this guys dad who originally owned the company but passed a few years ago.

So he comes out the second to last week of April to talk to Bob about his and to Ron about theirs. This was when my mom was in the hospital so I wasn't home but the wife was, he quoted her about $2100 which seems high. She said I wasn't home, he wanted her to call me but she refused as I was in ICU with Mom.

He came back once while I was working, and the wife was home but she didn't answer the door.

Came back on May 2. I was home this time. Talked him down to $1700 and he said he would do the job in about two weeks. I paid $500 down, as did Bob and Ron I think paid $1000 for his two drives.

Two weeks go by and it's not done. Said weather wasn't cooperative. Then another couple weeks. He said there was a death in the family and he would be travelling for a few weeks.

I had not personally called him, Bob did because he knew the guy and I was kinda letting it go thru him. He calls Bob back each time after a few days, says "oh it's been raining, can't do it until it really kinda dries out" which I get. It has been a rainy spring/summer.

But today is July 19 and still no drive. So Bob called him a few days ago but I still hadn't heard anything. So I call finally today and my calls go straight to VM.

Finally I look this guy up on the internet and see that this is a routine. The death in the family excuse, poor workmanship, not showing up, not calling back, one guy he told that his check for $2700 bounced and he'd need a cashier's check, which the guy did thinking he made a mistake with the funds transfer only to find out the NEXT day that the original check not only was cleared but literally cashed at the originating bank.

So today I called and left a message saying I require a call in the next 24-48 hours.

At this point, I want my driveway paved. I was thinking I'd just go with another company, one that doesn't have shit reviews online and try to get my deposit back but I doubt that's going to happen. It seems that many people have taken this guy to small claims or filed complaints with the State's Atty.

So, I suppose this is my fault for not checking online about this guy. But he was someone that someone I trusted vouched for. I guess that's a lesson learned, an expensive one.

For the record, he lives here in town. His address is on the BBB complaints. I drove past his place this morning, to see if it was an office or a house or what.

Or just have Panthro show up at the guy's house. At the least he can leave skid marks on the front lawn. At the most he can talk to the guy for a few minutes.

I've had it happen once and was able to work out a deal pretty quickly, but you are probably right. Its the best action I can think of.

It is only my guess but as the numbers stay pretty low and guy figures take is chances with small claims if it comes to it. Knows people will not hire a lawyer for $500. Maybe as was pointed out you get better luck as you bunch together and let him know.

Had a dispute with a landlord once similar. Her scam was to simply ignore people and keep security deposits for no good reason. I finally got her on phone and threatened to sue her and would get my money. She actually said go ahead it will cost you more. I said no it won't my cousin is my lawyer and will do it free just to shove it up her ass.

Well a week later I got check but her last stab was it was for deposit minus the cost of what it would be to file a suit. :lol:

That or he will put the business in his wife name and do the same shit again. I Google just about everyone I do any type of business with now and ask for 3 referrals if I don't personally know you. You'll be surprised how many people are making a living stealing from people.

No my neighbor wouldn't be involved in a ripoff. Dude is solid. He is out 500 as well and he's pissed. I just got back from his house. He took me over to the contractors house, but he wasnt home. He told me that if I don't get my money back or the work done he'll take care of me but I don't want that.
I know if I get a small claims judgment he just won't pay it. So I figure I'm pretty much out the money.
My neighbors brother in law is a homeland security Marshall. I guess he's willing to make a visit to the guys house and encourage him to refund.
