one of the drivers said when he saw ward run down the track it was plain as day. everyone saw him, and everyone was easily able to drive around him except for tony. he said it was not a racing incident.

i think tony is going to jail. he knows he did it on purpose too, otherwise you would have heard his story of how ward committed suicide. but you didnt, tony is keeping his mouth shut because he knows he committed murder.

Stewart's catching a break b/c the #Ferguson chaos has dominated all the news cycles since this happened.

I think the prosecutor/investigators thus far have said no criminal charges, but that's not final.

Probably almost impossible to prove any sort of murder charge--absent a statement of mens rea from Stewart himself.

Some sort of negligent homicide/manslaughter charge?

Ward's family will no doubt file a civil wrongful death suit against Stewart and likely prevail.

Stewart married? If not, he should consider marrying asap and transferring real property and other protectable assets to a wife. Kids would be even better.
Not saying this is the right thing to do; saying if you're Stewart, this is what you need to do now to avoid pauperization at the hands of the court system.

Otherwise, killing a 20 year old with the future earnings potental Ward appears to have had will wipe out Stewart financially for life. Judgments/monetary awards in wrongful death cases are coldly tied to the future earnings potential of the individual wronfully killed. If Ward had a bright future as a NASCAR driver, Stewart's on the hook for the lifetime earnings for such a driver (plus pain and suffering of the loved ones, etc). Yes, it's cheaper to wrongfully kill an older driver with less of a career remaining or a fast food wave slave.

i dont think there is any way to pin a murder charge on him. like you said, he would have to admit he intended to kill the kid.

but from what i saw, and from what i heard the other drivers on the track say, it is absolutely an involuntary manslaughter. you and me, had we drove close to someone walking down a road just to scare them, and then hit and killed them, would absolutely go to jail for a few years. no doubt about it.
