WHAT IF?

The FACTS come out that he says they had consensual Sex, he wore a condom, there is no evidence of her fighting back and there is video of her being able to walk in and out of his house?

years ago, I saw a girl I knew on Halloween at around 7 PM on Lincoln Ave. Her 2 friends where carrying her, she couldnt walk, I thought she was hammered and at 7 PM, it was a little strange. She grabbed me and said my name, and I had to hold her up, when her friends said they were taking her home. She called me later that week asking if she ran into me? and claimed she was RUFIEd, is that the result of every drugging scenario, I dont know, but if I saw her at 10 PM, I would think she was just drunk...nothing more.

Take it a step further. If she had a blood test, they would determine such drugs in her system. So if it is a Date Rape drug, then it might go back to Kane...and I will bet he has never purchased any or even directed anyone to put it in anyones drink....might not even have knowledge of it.

Then the situation arises of Kaner needing to drop dime on which buddy he knows that does buy it and use it? or he takes the rap?

I know it's possible. I just don't think so with Kaner. I think as soon as he became a star, he thought he was invincible in his mind. "No? WHAT THE FUCK? I'M KANER, BITCH." That's not really believable. I'm no Kane fan but could see or be willing to have doubt unless drugs are involved.

Once again, what is valid consent for the act of sex? If he asked and she said YES, but he was hammered and she was hammered or drugged?

I would have thought so too. But the same could have been said about Bill Cosby. Rape is an act of power. It's not about sex.

Remember, well before this, I was the ONLY person here who even considered the drastic thought of trading Kane, so nobody can say I am a fan. I know the guy is a an idiot with incredible talent, so my desire to defend him is almost nill.

However, when I see some post and some female radio people (Spain and DIcaro) there is a tone in the voice of anger and resentment, always followed with a "but he hasnt been charged" at the end.

In the end, I think Kane was dumb...and for that he is going to pay in some or numerous ways....but thoughts like "he is a serial rapist?"?

True. But that's what I think. This isn't a court of law. I've been on a jury for a murder trial. Took it seriously. If I were on Kaner's trial, I'd do the same and put aside my bias. But I won't be on that jury. Buffalo fan boys will be on that jury.

That's a really anti-feminist philosophy. It's really the infantilization of women. In no other aspect of life does being drunk excuse a person from responsibilty for his or her actions. My partner has a couple DUIs and I'm sure he would love to say he didn't consent to operate that vehicle.

Regret is not rape and therein lies the problem. There is a "feminist" movement insisting it is. And I'm not talking about a slimy creep purposely drugging a woman like Cosby. That's certainly rape. But I would submit that those instances are as rare as women lying about assaults.

In any case, we really have no facts about what occurred in this incident with Kane or if anything occurred at all, do we?

I don't get the "she'll take money to go away" in cases like this. She's already put her name out there, to some extent, by going to the police immediately after the alleged rape.

If the case proceeds to a criminal trial and conviction, she'll still get a healthy civil judgment payday that'll dwarf any settlement.

While it's never a good time to be a rapist, the climate today is such that there's no way Kane doesn't do time if he's convicted of the allegations. With the difference of a hotel room vs private home, It sounds like it's almost same fact pattern as the Mike Tyson case. Girl agrees to go back to hotel/home with a star athlete. Girl hangs out and then when the star athlete goes to close the deal, girl says "no"; but [ALLEGEDLY] star athlete refuses to take no for answer.

Tyson got 10 years with 4 suspended--first offense, seemingly same fact pattern. I'd guess Kane gets the same term, should this all end with a conviction.

A plea deal by Kaner might cut that in half (3-5). Prosecutors and judges hate it when perps force them to take a case to trial; and so they throw the proverbial book at criminal defendants who refuse to plea out and get convicted after a trial.

I agree 100% and while he is innocent at this point and might even be proven innocent, he is going to lose at this point...just a matter of how much he loses.

the only way kaner comes out of this is a HUGE Offensive push to prove she tried to set him up....thats it. Other than that, he is going to take some major hits
