For wrongful termination.

Not only should you get your contract money, you should sue for an additional 2 or 3 million.

Here's why. What did you say that's wrong?

You said she looked live a host doing a porn awards show.

Go before a judge and ask why that's a bad thing to say. Because then they'll have to argue that a legal profession is bad. Then they are the prejudiced ones. That argument won't hold up for them. You'll win.

It's not.

The Julie's of the world, while claiming Mac is sexist for this, is actually putting down the good women of the porn industry. A legal industry. They're just doing a job. She's hating on those women by claiming it's an insult. Ya know what, maybe it's a compliment. That's what a lawyer would say in court.

Like I said earlier, if he said she looked like a Doctor, nobody would be mad. What he said is the exact same thing as saying she looked like a Doctor.

Mac would win in court. No doubt in my mind.

Why isn't it comparable? Two employees posting a sexist tweet on their personal accounts. One got a slap on the wrist and one got fired immediately. It just so happened that one was very highly paid and one likely isn't.

But you had an almost exact same scenario play out like 2 weeks before where an employee wasn’t fired for something arguably worse . How does wrongful termination not cover that ? Does Mr Reinsdorf going to bat for you make that much of a difference ?

This is one of my areas of expertise because we insure these claims. You can fire someone for any reason except a prohibited reason- which are race, age, national origin etc.

They have a reason. Companies choose not to fire people everyday even when their performance is subpar, they are late to work, or they are assholes. That doesn’t mean you can’t fire another person for being late.

What you are describing would have legs if Bruce was white and Mac was black. Mac could argue, you didn‘t fire the white guy who did the same thing as me, and I am black.

Ask yourself one question, why was Mac fired? Is there any question it was because of that Tweet?

None of the other stuff matters. Did they fire him because he’s over 40? No. Because he’s a christian? No. Because he’s straight? No.

He was fired for a legal reason.

They don’t have to prove anything. It is not illegal to fire someone. They could fire Parkins right now. They just can’t do it because he’s Jewish.

Again though, the contract is another matter.

I am telling you this stuff with 100% certainty. It doesn’t mean he won’t or can’t sue to try to extract a settlement. But they had every right to fire him. The only valid claim would be contractual. I would have to see his contract to know if they had a right under it.

Nah. Him deleting it wouldn't be a factor in court. The suit wouldn't be thrown out. Christ, we had somebody beat McDonalds for not warning them that coffee was hot.

Mac has a case. I believe he would win.
