That does ignore the very real possibility that one of your clients who is willing to pay you tons of money for your work also pays the $10-$50 for an internet background check and it comes back with a link to your thoughts on race as posted here where at least a link to your profile here would certainly show up and the better background engines would likely hit on a few "keywords" in your actual history. All of a sudden that word of mouth that seems to work so well for you could turn into a negative. By your own doing, you've given up your anonymity on the internet.

Let's put it another way Steve.

Let's say you paid a lawyer to go over your posting history and let you know if you left yourself open to potential legal issues. Don't you think they would recommend you immediately edit all those posts and many others and/or delete your account?

People's myspace/facebook information is used against them all the time. Just recently, there was a case around here where a person was suing for invasion of privacy because an insurance company used her profile to show that she was going on trips and enjoying a high quality of life while claiming that she was not. I believe she lost. This site is no different, especially with how you have chosen to "brand" yourself.

That makes some sense. I suppose it's POSSIBLE for that scenario to play out. But highly unlikely and if it's shown in court that indeed the guy hired was more qualified, the case is won. As a defendant, I would request such a trial be heard by a judge anyway, so a jury would not be a factor. A jury can make too many mistakes and a Judge is less emotional and will generally decide a case based upon merit. Some of the things you attribute to me are exaggerated or inacurate too.

If you were conducting a job interview would you tell a prospective candidate that you would not hire a minority because of how it would look to clients?

My guess is no, and if it is, then can you please explain why?

Elmhurst Steve's nerves are well-founded. Assuming his company has 15 employees, his company falls under the federal equal opportunity laws. If so, he has basically admitted to discrimination offenses. His main defense is that there are always more qualified people. That is kind of shady, but is pretty much what you need to show. He has also admitted that he won't hire black people because it will hurt his reputation. That "also" would easily be enough to screw him over. Now, his somewhat shady defense looks like a front for something more sinister. In any event, his "I'll just go with a judge" tactic is pretty much SOL, since the cover sheet of the complaint would say "JURY TRIAL DEMANDED" in nice, big, bold, ALL-CAPS font. You don't get to beg out of that one.

In any event, maybe his wallpaper and painting business isn't as fantastically profitable as he makes it seem, and he has fewer than 15 people under his employment. He is still on quite precarious ground. It took me about seven minutes to find his company's web site. He has comments all over the web, both as Elmhurst Steve and under his real name. Helpfully, on websites that require a real name, he often includes "Elmhurst Steve" at the end of his comments, so you can quite easily link the two. His last name has a quirky spelling that makes Google searches that much more effective. And his company has a low enough web presence that any disgruntled interviewee could easily set up a free Blogspot website, write about everything he has discovered about Elmhurst Steve, and the site would quickly be on the first search page of Google, both for his own name and his company's name.

automator is a pretensious dick live. seeing del @ the rave in milwaukee on teh both sides of the brain tour in 6/00 was infinitely better than seeing him on the deltron tour at house of blues chicago in 11/00.

oh yeah and elmhurst steve is comedy, although i'm starting to think his brand might be that of a work-type antagonist.
