I think this is simple-minded BS.

You can say that about any event at any time that you didn't personally witness.

If he was charged and convicted, would we know exactly what happened? Maybe, maybe not. However, people would say that we do know that he raped the girl. And, while that would most likely be correct and this is what I would think, you can't say for certain.

So, how does the inverse, that he wasn't charged or convicted, mean that we don't know. I would think it would be the same in that we should say that he didn't rape the girl and, while that would most likely be the case, of course you can't be certain.

There was no scenario where you would know exactly what happened barring a full confession or video evidence from Kane. But, the implication here is that something did happen and we don't know when it should really be that probably nothing happened because we don't hold the evidence to think otherwise.

For the record, I was referring to Dan's "we'll never know what happened" thoughts as simple-minded.

His clear implication is that something happened when evidence shows more and more that it is quite possible that nothing happened at all.

It would seem that he is indicating that it would be better for Kane to have more evidence against him so that charges could be filed and he could be exonerated than it is for them to not even have enough evidence to charge him in the first place.

It's probably better for Bernstein that no charges are ever filed so he can continue to hint at or make accusations, etc. regarding Kane, and he never has to say he's wrong.
