Arrested in 2008, TMOD has been in custody for 14 years and was sentenced to 25...so not really a big deal to cut him loose at this point.

The only reason the Supreme Court was able to end-run the bill of rights and allow the Feds unfettered pre-trial detention is because Rehnquist came up with his bullshit impermissible punishment or permissible regulation dichotomy for pre-trial detention. If you're cooling your heels in a Federal lockup without bail, you're not being punished, you're being regulated...

It sucks, but somebody that is denied bail has not been denied due process. You also have to be charged with a crime to be held without bail so if you're denied bail you are NOT being held without being charged. JORR has been wrong and/or lying about this for weeks now.

Certainly under the current legal framework of legislation and supreme court rulings it comports with our present day warped due process. However, I'd say that when you're being treated exactly the same as someone serving a post-conviction sentence, then even under Rehnquist's logic that should be a violation of substantive due process. I'm not sure how you can look at 2 people locked up next to each other in a Federal correctional facility and say the one post-conviction is being punished while the other one pre-trial is not.

The point that you either don't understand or that you are glossing over is that Jorr has said people are being held indefinitely AND without being charged regarding their actions on January 6th. That is flat out not true.

yeah, I don't see the government holding people involved in January 6th without charges. Maybe if they take them to gitmo or otherwise out of the country they can claim they aren't entitled to standard due process? but that's for terrorists and I think only non-citizens at that.
